Terms and Conditions

1.  This contract is made on the date of this signed document between Bridge Kaldro Music of 2890
North Franklin Street, Christiansburg, VA 24073, a corporation called “Lessor” or “we” or “us” and
herein called “Lessee” or “You.” Please refer to this contract for any additional information
pertaining to early termination, purchase options, maintenance responsibilities and warranties, 
late and default charges. In exchange for payment you make, we agree to lease you the instrument
according to the terms of this rental agreement.

2. RENTAL PAYMENTS – You agree to make all rental payments in advance of each rental period. We
will consider as delinquent all payments that are received 10 or more days past due and you will
incur a $10 late fee. All rental payments less the $5 monthly service charges will be applied
toward the purchase of the instrument if rented on a continuous monthly basis. Rental payments are
not pro-rated. There will be a $35 fee for all returned checks.

3.    LIABILITY FOR LOSS OR DAMAGE – Unless you purchase the Liability Damage Waiver (LDW), you
will be responsible for loss, theft, destruction of or damage to the instrument from all causes. 
You will be liable for the Fair Market Value of the instrument on the date of loss. You are not
required to purchase the LDW, and it may not be available on all types of instruments. The LDW is
void if payments are past due or if instrument is returned to a school without contacting Bridge
Kaldro Music.  If you choose the LDW option by paying the LDW fee, you will not be liable for loss
of or damage of the instrument due to theft or fire.  For theft, you must furnish us with a Police
Report showing forced entry within 72 hours of the loss. The LDW does not cover mysterious
disappearance from the school band room or lockers, or school property. The LDW does not cover
theft without proof of breaking and entering. We will not replace the instrument and payments made
prior to the date of loss or damage are not refundable or transferable. If you claim a loss under
the LDW you agree that we are subrogated to all your rights, claims and remedies due to the loss of
the instrument including but in no way limited to your rights or any recoveries under any insurance
policies. LDW covers certain repairs at no charge to you unless the damage is due to your willful
act or negligence, in which case our standard repair rates apply. The LDW does not cover damage to
finishes, cosmetic damage to cases, reeds, drumsticks, mallets, heads, bow hair, rosin, brass and
woodwind mouthpiece loss, neck straps, and ligature and cap loss. Mouthpiece and ligature,
included with the instrument at time of rental, is covered upon presentation of the broken part.  
You add the LDW when this contract is initiated but you cannot add it later.  

4. REPAIRS - All repairs must be done only by Bridge Kaldro Music, or by our repair technician. You
will have sole responsibility to pay for the repair if there is damage resulting from your
negligence, misuse, or your failure to properly care for your instrument. Normal wear and tear
including small scratches dings, and nicks caused by daily use will be acceptable when returning an
instrument provided that they are purely cosmetic in nature and do not affect the operation of the
instrument. In the case of large scratches, significant dents, dings, loose bracings and other
damages, the Lessee is responsible for all repair costs. Bridge Kaldro Music reserves the right to
determine if repair is normal wear and tear or misuse.  

5. PURCHASE INFORMATION – The instrument shall remain property of Bridge Kaldro Music until it has
been paid for in full. You may have the option to purchase the instrument at any time during the
lease (if you are not in default of this contract.) If you exercise this option, the price you pay
will be the list price of the instrument and you will receive credit for the total of your monthly
payments exclusive of monthly service charges. Once your monthly payment exclusive of the monthly
service equals the list price, you will gain title of the instrument and our mutual obligations
under this agreement will cease. Discount prices may be available when purchased within the first
year; purchase must be made in 1 payment for discount.  

6. RETURNING YOUR INSTRUMENT – You may return the instrument at any time to terminate this
agreement. There are no refunds for early returns. You must return the instrument to Bridge Kaldro
Music. If the instrument is damage or defective when returned, or parts are missing, you may have
to pay additional fees for repair or replacement. When instrument is returned, you must pay for any
outstanding amounts. If instrument is returned, all monies toward the purchase of the instrument
are forfeited.      

7. CREDIT CARD AUTHORIZATION – If lessee is more than 60 days late in paying any sums due under
this agreement, Lessee hereby authorizes Bridge Kaldro Music to charge the credit card given at the
time of rental for payment of any sums due under this agreement, to include the remaining balance
of the purchase price less credit for previous rent paid, should equipment not be returned to
Bridge Kaldro Music. If renter’s check is unpaid, renter hereby authorizes his/her credit card to
be charged for both check amount and returned check fees.    

8.  AUTOPAY – Autopay is required either by credit card or by checking account.  The Lessee
authorizes the automatic debiting of credit card or checking account shown for monthly payments
under this agreement.  It is the Lessee’s responsibility to notify Bridge Kaldro Music of any
credit card change or checking account change. Under penalty of perjury, the named cardholder
(“you” or “your) has authorized Bridge Kaldro Music (“us” or “we”) to withdraw the indicated amount
from your checking account at the given Financial Institution or credit card on the payment due
date for the purpose of making payment on your Bridge Kaldro Music account. To revoke this
authorization please call (540) 381-8383 at least 3 business days before your next scheduled
payment due date. You are responsible and liable for all authorized transactions made under this
preauthorized agreement. We will not be liable for any fees your bank may assess if you do not have
sufficient funds in your account to cover the transfer. If paying from a checking account, a credit
card number is still required on file.  

9. INFORMATION ON BREACH OF THIS CONTRACT – If you are in default of this agreement your rearage
and all future payments will immediately become due. A. You will be in default of this contract if
(1) You fail to make payment to Bridge Kaldro within 60 days of your payment due date  (2) your
check is non-collectible, (3) You fail to notify Bridge Kaldro Music of a change in your address
and phone number in writing, (4) You fail to return the instrument, (5) You allow anyone other than
Bridge Kaldro Music to service the instrument, (6) You sell, assign, or attempt to sell or assign
the instrument, (7) You declare bankruptcy. B. If you are in default of this agreement, we may
terminate this agreement with you. If you owe us money that has remained unpaid for more than 60
days, and we sent this obligation to collection, all payments along with collection and legal fees
associated with these actions will be due. In addition to the principle amount owed, should your
account become past due, you agree to pay us liquidated damages calculated as 25% of the current
principle balance on your account in addition to attorney’s fees, court cost and interest at 18% 
annually (or 1.5% per month.) from the original due date.   Once we have sent your account to
collection, return of the instrument as credit toward this obligation will no longer be accepted.  

10. COMMUNICATIONS WITH YOU – You agree, in order for us to service your account with us, or to
collect any amounts you may owe, we, our agents, assignees, third party(s) or servicing agent(s) 
may contact you by telephone at any telephone number associated with your account, including
wireless telephone numbers, which could result in charges to you. Methods of contact may include
using pre-recorded/artificial voice messages and/or use of an automatic dialing service, as

11. NONDISCLOSURE/PRIVACY NOTICE – We at Bridge Kaldro Music, LLC recognize our obligation to
protect the security and confidentiality of the nonpublic personal information our customers
entrust to us. Bridge Kaldro Music employees are required, by law, to act responsibly and lawfully
regarding the collection and use of nonpublic and personal information, i.e. information that you
entrust to us or that we collect for the purpose of entering into a Rental or Sale Agreement
Contract with you, including your name, current address, social security number, credit card number
and expiration date, home and work telephone numbers, and employer information. Additionally we may
collect and retain information such as your credit score, credit history and credit references from
a consumer credit reporting agency. Bridge Kaldro Music will use your nonpublic personal
information only when necessary to effect, administer or enforce a transaction (rental or sale) 
requested by you. Although we do not otherwise sell, share or disclose your information to third
parties, federal law requires that we inform you as follows: You have the right to “Opt-Out” of the
sharing of your nonpublic personal information with third parties. Should you decide that you want
